Calcutta High Court Friday cancelled the decision taken by Medical Council of India (MCI) and West Bengal University of Health Sciences (WBUHS), to refuse affiliation to Haldia-based ICARE Institute of Medical Science and Research and directed it be allowed to function with immediate effect.
The Division Bench comprising Justice Nishita Matre and Justice Kanchan Chakraborty directed the state government, WBUHS and MCI to give the college recognition in two weeks. The Division Bench also imposed a fine of Rs 10,000 each to the state government, WBUHS and MCI, said advocate Ashoke Jena, counsel of ICARE.
The private medical college will begin admission process for this academic session, said Jena.
Haldia Medical College was set up in 2009-10 by ICARE, and admitted its first batch in August 2010. The college received the nod from the state government, WBUHS and MCI in 2010 to open a medical college.
On August 27, 2011 the medical college issued a notification announcing that first year examination would be held on September 11,2011 and the result be published in the same month. On November 16, 2011 the state issued a notification to cancel its recognition given to the medical college. WBUHS and MCI then withdrew its recognition, which was challenged by the medical college and students in the Calcutta High Court.
In 2012, a single bench of the Calcutta High Court cancelled the notification of the state government and the order of the single bench was challenged by the state and the MCI in the Division Bench. Friday, the Division Bench gave the final verdict in favour of the Haldia Medical College.
